Terms and Conditions

1. Introduction

Welcome to Sterne Performance. These Terms and Conditions (“Terms”) govern your participation in all coaching services provided by Sterne Performance, including in-person sessions, online coaching programs, and digital resources. By enrolling in any service, you agree to these Terms.

2. Services Provided

Sterne Performance offers:
2.1 Personal Training (in-person & online)
2.2 Athletic Development Programs
2.3 Strength and Conditioning Coaching
2.4 Golf Fitness Services
2.5 Nutritional guidance
2.6 Educational Resources (PDFs, videos, online content)
2.7 Membership Access (if applicable)

These services are tailored to individual or group needs and may include training programs, coaching calls, assessments, and ongoing support.

3. Eligibility

3.1 You must be 18 years or older to agree independently, or have consent from a parent/guardian if under 18.
3.2 By signing up, you confirm that you are medically cleared to participate in physical activity and will directly notify your coach of any health changes using the contact details in Section 18.

4. Health and Medical Disclaimer

4.1 All information provided is for educational and coaching purposes only.
4.2 You accept full responsibility for your health, injuries, or complications that may arise from any and all participation or involvement thereafter.
4.3 Programs are not a substitute for medical advice, diagnosis, or treatment.
4.4 It is your responsibility to consult a medical professional before starting any fitness program.

5. Liability Waiver

5.1 You agree to participate in any and all coaching (in-person or online) with Sterne Performance and its coaches, staff, and affiliates at your own risk.
5.2 Sterne Performance and its coaches are not liable for injuries or damages that may occur during training or through use of any provided content, instructions, or materials.
5.3 You release and discharge Sterne Performance from any and all claims related to your participation or involvement in any and/or all services with the company, its coaches, staff, and affiliates.

6. Indemnity

6.1 You agree to indemnify and hold harmless Sterne Performance, its coaches, and representatives against all liabilities, claims, damages, or expenses arising from your participation.
6.2 If services are delivered through a school or third-party institution, the school assumes all liability, and the participant is under the school’s insurance and policies.

7. Payment Terms

7.1 Payments are due in advance in British Pound Sterling (GBP) or other agreed methods.
7.2 Regardless of the actual payment method, the client shall provide a valid credit or debit card for payment of any service fees until the service is paid in full.
7.3 Subscription services will auto-renew unless cancelled prior to the renewal date (see 8.4).
7.4 No refunds will be issued once a program or service has begun unless otherwise stated.

8. Cancellations and Rescheduling

8.1 In-Person Sessions: A 24-hour notice period is required for cancellation. Less than 24 hours’ notice will result in the session being charged in full. Missed sessions without notice will be charged in full.
8.2 Online Coaching: Subscriptions may be cancelled only once the total agreed-upon term/period has been paid in full.
8.3 Online Programs: Subscriptions can be cancelled at any time; access remains until the end of the paid term.
8.4 Subscription Cancellation: All subscriptions require a 30-day notice period. Any unpaid fees within this period must be paid in full before cancellation is confirmed.
8.5 Sterne Performance reserves the right to cancel sessions or services due to unforeseen circumstances, with as much notice as possible.
8.6 To request a cancellation of any subscription, service or online program the client must email sterneperformance@gmail.com with their request.


9. Expirations

9.1 In-Person Sessions: Paid-in-full (PIF) or block bookings expire 6 months from the date of the first session/service.
9.2 Online Coaching: Online services will not be extended beyond the agreed-upon term. Subscriptions auto-renew until written cancellation is submitted via email.
9.3 In-Person Extensions: Only at the discretion of Sterne Performance will extensions be granted, on a case-by-case basis.
9.4 All sessions and services in-person or online are not transferable to another company, coach, staff or affiliate without agreed written consent from Sterne Performance.

10. Online Coaching Services Commitment Agreement

10.1 Enrolment to the online coaching program is a minimum 6 month contract agreement.
10.2 Refunds are not permitted subject to Sterne Performance cancellation and refund policies.
10.3 If Client no longer wishes to continue within the 6 month period, the Client will need to settle the full balance of the 6 month contract (if opted for payment plan).
10.4 Clients agreement will automatically enrol into a monthly subscription upon the expiration of the 6-month contract agreement unless the client has opted out and given the 30 day notice period.

11. Online Coaching Refund and Cancellation Policy Only

11.1 Clients may be eligible for a refund if they meet the following conditions within the first 30 days of the program:

11.1a All required weekly assessment forms must be completed.

11.1b All set tasks must be completed with evidence (screenshots etc.) 11.1c All programmed (non-optional) workouts within the Sterne Performance Custom Coaching App must be completed.

11.2 The 30-day refund window (“Refund Period”) begins after the first workout is completed in the app.
11.3 To request a refund, clients must email sterneperformance@gmail.com within the 30-day Refund Period.
11.4 Refund requests must be submitted by email and cannot be made through the coaching app.
11.5 If a refund request is approved only the program fee is refunded minus the first calendar month's subscription fee; any third-party costs (e.g., payment processing or application fees) are non-refundable.
11.6 After the 30-day refund period no refunds will be issued. Clients on a payment plan must complete the full agreed payment amount. Any breach of these terms voids the right to a refund. All sales are final.

12. Content Use and Intellectual Property

12.1 All programs, PDFs, videos, and resources are the intellectual property of Sterne Performance.
12.2 These materials may not be shared, resold, or redistributed without written permission.
12.3 Screenshots, session footage, photographs, or results may be used for promotional or marketing purposes with the prior consent from the client.

13. Communication and Coaching Expectations

13.1 Coaching includes messaging support within reasonable hours (Mon–Fri, 8AM–6PM).
13.2 Responses will be provided within 24–48 hours.
13.3 Respectful communication is expected at all times.
13.4 Communications will be delivered through the channels appropriate to the service.

14. Membership and App Access

14.1 App access (e.g., TrueCoach) and member content are for paying clients only.
14.2 Access is revoked upon cancellation or non-payment.
14.3 Misuse of the platform will result in account termination.
14.4 Access is limited to the individual client; sharing login or content is not permitted.

15. Termination of Services

Sterne Performance reserves the right to terminate services if:
15.1 Terms are violated
15.2 Payment is not received
15.3 Coaching relationship becomes unproductive or inappropriate
15.4 Any behavior negatively harms or risks the business

16. Amendments

16.1 These Terms may be updated periodically. Clients will be notified of changes via email or the member platform.

17. Governing Law

17.1 These Terms are governed by the laws of the United Kingdom. Any disputes shall be resolved under UK jurisdiction.
